Penalties for DUI/DWI convictions in New Jersey vary based on the severity of the alleged offense and the driver’s record. They typically include fines, license suspension, and possible jail time. Repeat DWI offenses and higher BAC levels result in harsher penalties, including longer jail terms and extended license suspensions. Some offenders must install ignition interlock devices in their vehicles after these suspension periods. New Jersey also requires all offenders to participate in an Intoxicated Driver Resource Center (IDRC) program.

First Offense Penalties

•  If an offender’s BAC is over 0.08 percent but less than 0.10 percent, they are subject to a fine between $250 and $400 and imprisonment for up to 30 days. They must also install ignition interlock devices (IIDs) on their vehicles for three months following a license forfeiture.
• For a BAC of 0.10 percent to 0.15 percent, penalties include $300 to $500 in fines, up to 30 days’ imprisonment, and seven to 12 months of IID installation.
• Offenders with a BAC of 0.15 percent or higher must install an IID during license suspension periods of four to six months and for nine to 15 months after license restoration.
• In all cases, offenders must attend classes at the IDRC for two consecutive days and face an annual auto insurance surcharge of $1,000 for three years.

Second Offense Penalties

• A second offense carries a fine ranging from $500 to $1,000, imprisonment of at least 48 hours and up to 90 days, and a license revocation for a minimum of one year and a maximum of two years.
• Additionally, offenders must complete the IDRC’s evaluation, referral, and program requirements, perform 30 days of community service, and pay an automobile insurance surcharge of $1,000 annually for three years.
• Second-time offenders must also install ignition interlock devices on their vehicles for the period of license suspension and two to four years following license restoration.

Third and Subsequent Offense Penalties

• The penalties for each offense beyond the second include a $1,000 fine, imprisonment for up to 180 days, and an eight-year license forfeiture.
• Offenders must also perform 30 days of community service, complete IDRC requirements, and pay an automobile insurance surcharge of $1,500 annually for three years.
• These offenders must also install IIDs on their vehicles for the duration of their license suspensions and two to four years after restoration.
